David O’Steen is an experienced intellectual property (IP) and tech attorney. He has helped inventors, founders, artists, cultural institutions, multinational corporations, research institutions, and startups with navigating the challenges and opportunities that arise at the intersection of the arts and technology with our legal system. Mr. O’Steen has advised his clients in intellectual property matters, from the application and registration of IP rights through their licensing and enforcement. Mr. O’Steen has extensive experience negotiating a wide variety of complex commercial agreements related to technology and media including:
- contractor and vendor agreements;
- software-as-a-service (SaaS) agreements;
- artwork consignment agreements;
- terms of use;
- joint venture agreements; and
- IP licenses of all kinds.
Mr. O’Steen has an active pro bono practice and has helped clients through Locust Projects in Miami and Dade Legal Aid.
Mr. O’Steen has held associate roles at international law firms in Manhattan and Miami, where he worked on complex mergers and acquisitions, IP transactions, patent and trademark prosecution, intellectual property arbitration, and Uniform Domain-Name Dispute-Resolution Policy (UDRP) processes. Additionally, his tenure at a boutique IP litigation firm gave him valuable experience in patent litigation in federal court, investigations at the International Trade Commission, and representing clients at the United States Patent and Trademark Office (USPTO). Further, Mr. O’Steen has served as in-house counsel for companies ranging from early-stage startups to publicly traded companies operating in the payments, blockchain, virtual reality, and hospitality fields. In these roles, he provided guidance and counseling regarding a broad range of legal matters to executive officers, engineers, sales representatives and other employees at these companies. Prior to attending law school, Mr. O’Steen was a patent broker, IP consultant and patent examiner for the USPTO.
He proudly serves as co-chair of the Miami-Dade Bar Association’s intellectual property committee and is active with the Florida Bar’s International Law Section. In addition, Mr. O’Steen has served as an adjunct professor at FIU Law.
